The Tunisian government lifts reservations to the CEDAW

 

It is another important step toward gender equality for Tunisia: after the adoption of a new Constitution ensuring gender equality, Tunisia officially withdraws its specific reservations to the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW).

Reminder

Tunisia ratified the CEDAW in 1985 with reservations to some articles and with a general declaration:

 

  • The reservations concerned treaty requirements to provide equality to women in family matters. These include passing on their nationality to their children, rights and responsibilities in marriage and divorce, matters relating to children and guardianship, personal rights for husbands and wives with regard to family name and occupation, and ownership of property.
  • The General Declaration states that the government “shall not take any organizational or legislative decision in conformity with the requirements of this Convention where such a decision would conflict with the provisions of chapter I of the Tunisian Constitution.”

 

In August 2011 the Tunisian Council of Ministers adopted a draft decree to withdraw all reservations to the CEDAW. But it was not notified to the United Nations Secretary General until today. The withdrawal of Tunisia’s reservations is now effective.

The general declaration however remains in effect.
